Welcome to StepUp! These Terms and Conditions govern your access to and use of the StepUp mobile application (“Application”), and any video tutorials, information, text, graphics, or other materials uploaded, downloaded, or appearing on the Application (collectively referred to as “Content”). By accessing or using the Application, you signify that you have read, understood, and agree to be bound by these Terms and Conditions.
1. Acceptance of Terms
By creating an account and using StepUp, you agree to comply with and be legally bound by these Terms. If you do not agree to these terms, please do not access or use the Application.
2. Changes to Terms
StepUp reserves the right to modify these Terms at any time. We will provide notice of any changes by posting the updated Terms to the Application and updating the “Last Updated” date. Your continued use of the Application after any such change constitutes your acceptance of the new Terms.
3. User Accounts
To access certain features of the Application, you must register for an account. When registering, you must provide accurate and complete information. You are responsible for maintaining the confidentiality of your account and password.
4. User Conduct
You are responsible for all your activity in connection with the Application. The following types of Content are prohibited:
- Content that is defamatory, obscene, pornographic, abusive, offensive, or otherwise violates any law or right of any third party.
- Content that you do not have a right to make available under any law or under contractual or fiduciary relationships.
- Content that is invasive of another’s privacy, or harmful to minors in any way.
5. Intellectual Property
All intellectual property rights in the Application and Content are owned by or licensed to StepUp. We grant you a limited, non-exclusive, non-transferable, and revocable license to use the Application and Content for your personal, non-commercial use.
6. Content Posted by Users
You retain all of your ownership rights in your Content. By submitting Content to StepUp, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, distribute, and display your Content in connection with the Application.
7. Termination
StepUp may terminate or suspend your account and access to the Application immediately, without prior notice or liability, for any reason whatsoever, including, without limitation, if you breach the Terms.
8. Disclaimers
The Application and all included Content are provided on an “as is” basis without warranty of any kind, whether express or implied.
StepUp specifically disclaims any and all warranties and conditions of merchantability, fitness for a particular purpose, and non-infringement, and any warranties arising out of course of dealing or usage of trade.
9. Limitation of Liability
To the maximum extent permitted by law, StepUp shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction of StepUp’s registration, without regard to its conflict of law provisions.
